1.1. Настоящий документ (далее — «Документ», «Правовая информация», «Политика») разработан в соответствии с законодательством Европейского Союза, включая Регламент (ЕС) 2016/679 (GDPR), действующее законодательство Италии, а также международные правовые акты в сфере защиты персональных данных.
1.2. Сервис ItaGuide (сайт ita.guide) — кураторские интерактивные карты Венеции и Рима, включая бесплатный доступ (Open), платный доступ (Prime) к закрытым материалам и маршрутам, журнал и сопутствующие информационные материалы, предназначенные для неограниченного круга пользователей независимо от их гражданства, языка или статуса.
1.3. Оператором и администратором сервиса ItaGuide является ItaProfile и его законный владелец/администратор (далее — «Оператор»), [...]. Все упоминания «ItaProfile» и «ItaGuide» в настоящем документе включают владельца, администраторов и иных уполномоченных лиц.
1.4. Сайт и все его материалы (включая, но не ограничиваясь: тексты, изображения, описания мест, маршруты, ориентировочные цены, графику, аудио) носят преимущественно демонстрационный и информационный характер.
1.5. Информационные материалы Сайта не являются публичной офертой. Условия предоставления платного доступа (Prime) согласовываются в индивидуальном порядке; оформление доступа осуществляется через личный кабинет и электронную почту access@itaprofile.com, а также официальные каналы связи, указанные на itaprofile.com/contact. Любые иные каналы связи, включая социальные сети, не создают юридических обязательств.
1.6. Используя Сайт, Пользователь подтверждает своё согласие с настоящим Документом. В случае несогласия Пользователь обязан прекратить использование Сайта.
1.7. ItaProfile оставляет за собой право изменять или обновлять настоящий Документ в любое время без предварительного уведомления. Пользователь обязуется самостоятельно отслеживать изменения; продолжение использования Сайта означает согласие с новой редакцией.
1.8. ItaProfile предоставляет все материалы и информацию на условиях «как есть» (as is) и «как доступно» (as available), без каких-либо гарантий, включая, но не ограничиваясь: гарантиями точности, полноты, актуальности, пригодности для конкретной цели, непрерывности работы Сайта и отсутствия ошибок. Пользователь принимает на себя все риски, связанные с использованием информации. ItaProfile не несёт ответственности за любые прямые, косвенные, случайные, особые или последующие убытки, включая упущенную выгоду или потерю данных, возникшие в результате использования Сайта или невозможности его использования.
Для целей настоящего Документа используются следующие термины:
3.1. Пользователь обязуется использовать Сайт исключительно в законных целях и не предпринимать действий, нарушающих права ItaProfile или третьих лиц.
3.2. Запрещается: размещать недостоверные данные; копировать материалы без письменного разрешения; использовать Сайт для противоправных действий или рассылки спама; загружать или передавать вирусы, вредоносные коды или иные программы, способные нарушить работу Сайта; использовать Сайт с целью нанесения ущерба репутации ItaProfile; передавать, перепродавать или совместно использовать коды доступа Prime.
3.3. ItaProfile вправе изменять содержимое Сайта, включая тексты, изображения, цены, состав карт и функционал, без предварительного уведомления Пользователей, и не несёт ответственности за возможные последствия таких изменений.
4.1. Все материалы на Сайте (описания мест, маршруты, цены, фотографии, статьи, тексты) носят преимущественно ознакомительный характер.
4.2. Указанные цены являются ориентировочными и могут отличаться от фактических.
4.3. ItaProfile не несёт ответственности за: ошибки или неточности информации; устаревшие данные; технические сбои работы Сайта; действия третьих лиц (Google, Supabase, Mapbox, хостинг-провайдеры, почтовые сервисы).
4.4. Социальные сети и сторонние площадки. ItaProfile ведёт официальные аккаунты в социальных сетях (Instagram и др.). Публикации носят демонстрационный характер, не являются публичной офертой, не создают обязательств и не могут рассматриваться как окончательные условия предоставления услуг. ItaProfile не несёт ответственности за трактовку, использование или последствия применения такой информации, а также за комментарии и упоминания третьих лиц.
4.5. ItaProfile не несёт ответственности за любые косвенные убытки, упущенную выгоду, потерю данных или моральный вред, возникшие в результате использования Сайта, его материалов или сторонних сервисов, даже если возможность таких убытков была предсказуема.
4.6. ItaProfile не контролирует и не несёт ответственности за содержание сайтов третьих лиц, ссылки на которые могут присутствовать на Сайте.
4.7. ItaProfile прикладывает усилия для точности информации, но не гарантирует её полноту, актуальность и соответствие фактическим условиям. В случае несоответствия опубликованных данных фактическим ItaProfile не несёт ответственности за такие расхождения; Пользователь обязуется проверять актуальность информации самостоятельно.
4.8. ItaProfile не гарантирует бесперебойную работу Сайта, его совместимость с программным обеспечением или устройствами Пользователя, а также отсутствие ошибок или сбоев.
5.1. Все материалы на Сайте защищены авторским правом.
5.2. Копирование и использование материалов без письменного согласия ItaProfile запрещено.
5.3. Фотографии, изображения и описания могут носить иллюстративный характер; внешний вид объектов и маршрутов в действительности может отличаться. Такие отличия не являются нарушением и не могут являться основанием для претензий.
5.4. ItaProfile использует как собственные материалы, так и изображения/видео на основании лицензий или из открытых источников. В случае, если какой-либо контент нарушает авторские права третьих лиц, соответствующее лицо вправе направить уведомление на ciao@itaprofile.com, и ItaProfile рассмотрит обращение и при подтверждении нарушения удалит или заменит контент. Претензии предъявляются в досудебном порядке.
5.5. Несанкционированное использование материалов (копирование, распространение, модификация) влечёт ответственность в соответствии с применимым законодательством.
Настоящая Политика регулирует обработку и защиту персональных данных, собираемых через сервис ItaGuide, в соответствии с Регламентом (ЕС) 2016/679 (GDPR), законодательством Италии (Codice in materia di protezione dei dati personali, D.Lgs. 196/2003) и иными применимыми актами.
ItaGuide может собирать и обрабатывать:
Сервис ItaGuide намеренно не использует рекламные cookie, аналитику и трекеры и не собирает данные о Пользователе на других сайтах. Если Пользователь передаёт избыточные или чувствительные данные (ст. 9 GDPR), ответственность за такую передачу несёт сам Пользователь; данные обрабатываются временно и удаляются по первому требованию.
Обработка осуществляется на основании: согласия субъекта данных (ст. 6.1(a)); необходимости для исполнения договора — предоставление доступа Prime (ст. 6.1(b)); соблюдения правовых обязательств (ст. 6.1(c)); законных интересов Оператора — безопасность и работа Сайта (ст. 6.1(f)).
Данные хранятся в течение периода, необходимого для достижения целей обработки, но не более 3 лет с момента последнего взаимодействия, после чего удаляются или обезличиваются. ItaProfile применяет технические и организационные меры защиты (SSL-шифрование, ограничение доступа, резервное копирование). Пользователь вправе в любой момент запросить удаление своих данных.
Для работы сервиса данные могут передаваться поставщикам, каждый из которых обрабатывает данные по своим условиям:
Все третьи лица обязаны обеспечивать адекватную защиту данных в соответствии с GDPR.
Данные могут храниться на серверах за пределами Италии ([ЕС/ Великобритания / США]). В таких случаях применяются Standard Contractual Clauses (SCCs). Пользователь уведомлён и соглашается с возможными рисками трансграничной передачи.
Оплата доступа Prime оформляется вне Сайта: после запроса Пользователь получает код и инструкции на электронную почту. Данные банковских карт на Сайте не собираются и не хранятся. [платёжный сервис используется, если применимо в определенном случае]
Пользователь имеет право: на доступ к своим данным; на исправление и обновление; на удаление («право быть забытым»); на ограничение обработки; на переносимость данных; на возражение против обработки; на отзыв согласия в любой момент; на подачу жалобы в надзорный орган (Garante per la protezione dei dati personali, Италия). ItaProfile обязуется обрабатывать данные только для заявленных целей; обеспечивать их конфиденциальность и целостность; уведомлять надзорные органы и Пользователей о случаях утечки данных в срок не более 72 часов (ст. 33 GDPR).
Пользователь несёт полную ответственность за достоверность предоставленных данных. ItaProfile не несёт ответственности за обработку данных, если Пользователь самостоятельно передал их третьим лицам, а также за дальнейшую обработку данных официальными сервисами (Google, Supabase, Mapbox и др.), регулируемую их собственными политиками конфиденциальности.
7.1. Использование технического хранилища осуществляется в соответствии с GDPR и Директивой ЕС о конфиденциальности и электронных коммуникациях (ePrivacy 2002/58/EC).
7.2. Сервис ItaGuide использует только строго необходимое и функциональное локальное хранилище (localStorage) браузера Пользователя: сохранение сессии и доступа, избранного, выбранного тарифа и настроек интерфейса. Такое хранилище обеспечивает базовую работу Сайта и не требует отдельного согласия.
7.3. Сайт не использует аналитические, рекламные или трекинговые cookie и не отслеживает Пользователя на сторонних ресурсах. Если такие cookie будут установлены сторонними сервисами (например, при загрузке карт), ответственность за их обработку несут соответствующие провайдеры согласно их политикам.
7.4. Пользователь может в любой момент очистить или заблокировать локальное хранилище и cookie через настройки браузера. Отключение может ограничить функциональность Сайта (в частности, вход и сохранение избранного).
7.5. ItaProfile не несёт ответственности за ограничение функциональности Сайта при отключении хранилища, а также за cookie, устанавливаемые сторонними сервисами.
8.1. Права Пользователя: получать информацию о своих данных; требовать удаления; отзывать согласие; жаловаться в Garante Privacy (Италия).
8.2. Обязанности Пользователя: предоставлять достоверные и актуальные данные, относящиеся только к себе; не передавать незаконные, ложные или принадлежащие третьим лицам данные без их согласия; не предпринимать действий, способных повредить работе Сайта или репутации ItaProfile.
8.3. Обязанности Оператора: хранить данные безопасно; использовать их только в заявленных целях; уведомлять о нарушениях безопасности.
8.4. Форс-мажор. В случае наступления обстоятельств непреодолимой силы (эпидемии, пандемии, военные действия, забастовки, отключения Интернета, блокировки сервисов, стихийные бедствия, правительственные ограничения, изменения законодательства) ItaProfile освобождается от обязательств перед Пользователями и не несёт ответственности за полное или частичное неисполнение обязательств.
9.1. ItaProfile вправе изменять настоящий Документ без предварительного уведомления. Новая редакция вступает в силу с момента публикации на Сайте. Продолжение использования Сайта означает согласие с актуальной редакцией.
9.2. Все обращения рассматриваются исключительно в письменной форме на русском или английском языке (электронной почтой или через официальные мессенджеры). Устные или неофициальные сообщения (комментарии и переписка в социальных сетях) не являются юридически значимыми уведомлениями.

1.1. This document (hereinafter the "Document", "Legal Information", "Policy") has been prepared in accordance with the law of the European Union, including Regulation (EU) 2016/679 (GDPR), the applicable law of Italy, and international legal instruments in the field of personal data protection.
1.2. The ItaGuide service (the website ita.guide) provides curated interactive maps of Venice and Rome, including free access (Open), paid access (Prime) to closed materials and routes, a journal and related informational materials, intended for an unlimited range of users regardless of their citizenship, language or status.
1.3. The operator and administrator of the ItaGuide service is ItaProfile and its lawful owner/administrator (hereinafter the "Operator"), [...]. All references to "ItaProfile" and "ItaGuide" in this document include the owner, administrators and other authorised persons.
1.4. The Site and all its materials (including, without limitation: texts, images, descriptions of places, routes, indicative prices, graphics, audio) are predominantly of a demonstrative and informational nature.
1.5. The informational materials of the Site do not constitute a public offer. The terms of paid access (Prime) are agreed on an individual basis; access is arranged through the personal account and the email address access@itaprofile.com, as well as the official communication channels listed at itaprofile.com/contact. Any other communication channels, including social networks, do not create legal obligations.
1.6. By using the Site, the User confirms their agreement with this Document. Should the User disagree, they must cease using the Site.
1.7. ItaProfile reserves the right to amend or update this Document at any time without prior notice. The User undertakes to monitor changes independently; continued use of the Site constitutes agreement with the new version.
1.8. ItaProfile provides all materials and information on an "as is" and "as available" basis, without any warranties, including, without limitation: warranties of accuracy, completeness, currency, fitness for a particular purpose, uninterrupted operation of the Site and freedom from errors. The User assumes all risks associated with the use of the information. ItaProfile shall not be liable for any direct, indirect, incidental, special or consequential damages, including lost profit or loss of data, arising from the use of the Site or the inability to use it.
For the purposes of this Document, the following terms are used:
3.1. The User undertakes to use the Site solely for lawful purposes and not to take any action that infringes the rights of ItaProfile or third parties.
3.2. It is prohibited to: post inaccurate data; copy materials without written permission; use the Site for unlawful actions or the sending of spam; upload or transmit viruses, malicious code or other programs capable of disrupting the Site; use the Site with the aim of damaging the reputation of ItaProfile; transfer, resell or share Prime access codes.
3.3. ItaProfile is entitled to change the content of the Site, including texts, images, prices, the composition of the maps and functionality, without prior notice to Users, and shall not be liable for any consequences of such changes.
4.1. All materials on the Site (descriptions of places, routes, prices, photographs, articles, texts) are predominantly of an informational nature.
4.2. The prices stated are indicative and may differ from the actual ones.
4.3. ItaProfile shall not be liable for: errors or inaccuracies in the information; outdated data; technical failures of the Site; the actions of third parties (Google, Supabase, Mapbox, hosting providers, email services).
4.4. Social networks and third-party platforms. ItaProfile maintains official accounts on social networks (Instagram and others). Publications are of a demonstrative nature, do not constitute a public offer, create no obligations and cannot be regarded as the final terms for the provision of services. ItaProfile shall not be liable for the interpretation, use or consequences of applying such information, nor for the comments and mentions of third parties.
4.5. ItaProfile shall not be liable for any indirect damages, lost profit, loss of data or moral harm arising from the use of the Site, its materials or third-party services, even if the possibility of such damages was foreseeable.
4.6. ItaProfile does not control and is not liable for the content of third-party sites to which links may appear on the Site.
4.7. ItaProfile makes efforts to ensure the accuracy of the information but does not guarantee its completeness, currency or correspondence to actual conditions. In the event of any discrepancy between the published data and the actual conditions, ItaProfile shall not be liable for such discrepancies; the User undertakes to verify the currency of the information independently.
4.8. ItaProfile does not guarantee the uninterrupted operation of the Site, its compatibility with the User's software or devices, or the absence of errors or failures.
5.1. All materials on the Site are protected by copyright.
5.2. Copying and use of the materials without the written consent of ItaProfile is prohibited.
5.3. Photographs, images and descriptions may be illustrative; the actual appearance of objects and routes may differ. Such differences do not constitute a violation and cannot serve as grounds for claims.
5.4. ItaProfile uses both its own materials and images/video under licence or from open sources. Should any content infringe the copyright of third parties, the relevant person may send a notice to ciao@itaprofile.com, and ItaProfile will review the request and, upon confirmation of the infringement, will remove or replace the content. Claims are submitted on a pre-litigation basis.
5.5. Unauthorised use of the materials (copying, distribution, modification) entails liability in accordance with applicable law.
This Policy governs the processing and protection of personal data collected through the ItaGuide service, in accordance with Regulation (EU) 2016/679 (GDPR), the law of Italy (Codice in materia di protezione dei dati personali, D.Lgs. 196/2003) and other applicable acts.
ItaGuide may collect and process:
The ItaGuide service deliberately does not use advertising cookies, analytics or trackers and does not collect data about the User on other sites. Should the User provide excessive or sensitive data (Art. 9 GDPR), responsibility for such disclosure rests with the User themselves; the data is processed temporarily and deleted upon first request.
Processing is carried out on the basis of: the consent of the data subject (Art. 6(1)(a)); the necessity for the performance of a contract — the provision of Prime access (Art. 6(1)(b)); compliance with legal obligations (Art. 6(1)(c)); the legitimate interests of the Operator — the security and operation of the Site (Art. 6(1)(f)).
Data is stored for the period necessary to achieve the purposes of processing, but no longer than 3 years from the last interaction, after which it is deleted or anonymised. ItaProfile applies technical and organisational protection measures (SSL encryption, access restriction, backup). The User is entitled to request the deletion of their data at any time.
For the operation of the service, data may be transferred to providers, each of which processes the data under its own terms:
All third parties are required to ensure adequate protection of the data in accordance with the GDPR.
Data may be stored on servers outside Italy ([EU / United Kingdom / USA]). In such cases, Standard Contractual Clauses (SCCs) apply. The User is notified of, and agrees to, the possible risks of cross-border transfer.
Payment for Prime access is arranged off the Site: after a request, the User receives a code and instructions by email. Bank card details are not collected or stored on the Site. [a payment service is used where applicable in a given case]
The User has the right: to access their data; to rectification and updating; to erasure (the "right to be forgotten"); to restriction of processing; to data portability; to object to processing; to withdraw consent at any time; to lodge a complaint with a supervisory authority (Garante per la protezione dei dati personali, Italy). To exercise these rights: ciao@itaprofile.com.
ItaProfile undertakes to process data only for the stated purposes; to ensure its confidentiality and integrity; and to notify the supervisory authorities and Users of data breaches within no more than 72 hours (Art. 33 GDPR).
The User bears full responsibility for the accuracy of the data provided. ItaProfile shall not be liable for the processing of data where the User has independently transferred it to third parties, nor for the further processing of data by official services (Google, Supabase, Mapbox and others), governed by their own privacy policies.
7.1. The use of technical storage is carried out in accordance with the GDPR and the EU Directive on privacy and electronic communications (ePrivacy 2002/58/EC).
7.2. The ItaGuide service uses only strictly necessary and functional local storage (localStorage) in the User's browser: saving the session and access, favourites, the selected tariff and interface settings. Such storage ensures the basic operation of the Site and does not require separate consent.
7.3. The Site does not use analytical, advertising or tracking cookies and does not track the User on third-party resources. Should such cookies be set by third-party services (for example, when loading maps), responsibility for their processing rests with the respective providers in accordance with their policies.
7.4. The User may at any time clear or block local storage and cookies through the browser settings. Disabling them may limit the functionality of the Site (in particular, sign-in and the saving of favourites).
7.5. ItaProfile shall not be liable for any limitation of the Site's functionality when storage is disabled, nor for cookies set by third-party services.
8.1. User rights: to receive information about their data; to demand deletion; to withdraw consent; to complain to the Garante Privacy (Italy).
8.2. User obligations: to provide accurate and current data relating only to themselves; not to transfer unlawful, false or third-party data without their consent; not to take any action capable of harming the operation of the Site or the reputation of ItaProfile.
8.3. Operator obligations: to store data securely; to use it only for the stated purposes; to notify of security breaches.
8.4. Force majeure. Should circumstances of force majeure arise (epidemics, pandemics, acts of war, strikes, internet outages, blocking of services, natural disasters, governmental restrictions, changes in legislation), ItaProfile is released from its obligations towards Users and shall not be liable for the full or partial non-performance of obligations.
9.1. ItaProfile is entitled to amend this Document without prior notice. The new version takes effect from the moment of its publication on the Site. Continued use of the Site constitutes agreement with the current version.
9.2. All communications are considered solely in written form, in Russian or English (by email or through official messengers). Oral or informal messages (comments and correspondence on social networks) do not constitute legally significant notices.
